Terms of App Usage

Welcome to Cultrite (“we,” “us,” “our”). These Terms of App Usage (“Terms”) govern your access to and use of our mobile application, website, and related services (collectively, the “App”).
By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

 

1. Eligibility

To use the App, you must:

  • Be at least 13 years old (or the minimum age required in your jurisdiction);

  • Have the legal capacity to enter into binding agreements;

  • Use the App only for personal, non-commercial purposes unless expressly authorized.

 

2. User-Generated Content (UGC)

The App allows you to upload, submit, or create content including images, selfies, and virtual try-on photos (“User Content”).
You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:

  • Host, store, process, modify, display, and reproduce User Content,

  • Operate, improve, and develop the App (including training algorithms),

  • Promote the App, only using anonymized or aggregated content unless you give explicit consent otherwise.

You represent and warrant that:

  • You either own the content or have permission to use it;

  • Your content does not infringe on any third-party rights, including privacy, publicity, and intellectual property rights;

  • Your content complies with all applicable laws.

 

3. Prohibited Content

You must not upload, create, or share any content that is:

A. Illegal or Harmful

  • Child sexual abuse material (CSAM) or any content involving minors in sexualized contexts

  • Criminal, dangerous, or harmful activities

  • Content that violates any law, regulation, or court order

B. Inappropriate or Unsafe

  • Nudity, pornography, sexual content, or sexually suggestive imagery

  • Graphic or gratuitous violence

  • Self-harm or suicide content

  • Hate speech, harassment, threats, or discriminatory content

C. Misleading or Fraudulent

  • False representations of identity

  • Deepfakes or manipulated content intended to deceive

  • Commercial advertising without prior authorization

D. Privacy-Violating

  • Images of people taken or shared without their consent

  • Personal data that you do not have permission to disclose

  • Sensitive personal information (such as medical data, biometrics, or financial details) unless required for app functionality

 

4. Content Moderation & Enforcement

We reserve the right—but not the obligation—to monitor, review, or moderate User Content.
We may remove or restrict content or suspend or terminate accounts at our sole discretion, without notice, including if you:

  • Upload prohibited content;

  • Engage in abusive or harmful behavior;

  • Misuse the App or breach these Terms.

We may also report illegal activity to the appropriate authorities.

We are not required to maintain or store removed content.

 

5. Privacy & Data Use

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and store your data, including images and biometric information where applicable.

By using the App, you consent to:

  • Image processing for virtual try-on functionality

  • Model training or performance improvement using anonymized data

  • Storage and handling of your content as described in the Privacy Policy

 

6. Intellectual Property Rights

All trademarks, logos, designs, interface elements, algorithms, and other intellectual property on the App belong to us and are protected by law.
You agree NOT to:

  • Copy, modify, reverse engineer, or exploit any part of the App

  • Use the App for commercial purposes without authorization

 

7. App Restrictions

You may NOT:

  • Upload viruses, malware, or harmful code

  • Attempt to bypass security features

  • Interfere with the App’s operations or the user experience

  • Use automated systems (bots, scraping tools, etc.) to access the App

 

8. Disclaimer of Warranties

The App is provided “as is” and “as available.”
We do not guarantee:

  • That the App will be error-free or uninterrupted

  • That virtual try-on results will be accurate, reliable, or suitable for specific uses

  • That user-generated content is safe, lawful, or truthful

You use the App at your own risk.

 

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

  • User Content (including offensive or illegal content uploaded by users)

  • Losses arising from use or inability to use the App

  • Any indirect, incidental, special, consequential, or punitive damages

  • Any unauthorized access to or use of your content or data

Our total liability will not exceed the amount you paid us in the last 12 months (if any).

 

10. Termination

We may suspend or terminate your access to the App at any time, for any reason, including violations of these Terms.
You may stop using the App at any time.
Sections relating to intellectual property, data rights, limitations of liability, indemnity, and disclaimers survive termination.

 

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses arising from:

  • Your User Content

  • Your violation of these Terms

  • Your misuse of the App

  • Any infringement of third-party rights

 

12. Third-Party Services

The App may integrate with third-party tools. We are not responsible for their content, policies, or actions.
Your use of third-party services is at your own risk.

 

13. Changes to These Terms

We may update these Terms at any time. Changes take effect when posted. Continued use of the App means you accept the updated Terms.

 

14. Governing Law

These Terms are governed by the laws of Florida, without regard to conflict-of-law principles.
